At Maui Jim USA, Inc. (“Maui Jim”) we are serious about protecting the image of our products and the integrity of our retail network. As such, we unilaterally refuse to supply to any person offering Maui Jim products for sale below the manufacturer’s suggested retail price or to any person that sells Maui Jim products to others for resale.
Shipping: Merchandise is customarily shipped and insured via UPS. Expedited service is available. All returns, exchanges and warranty repairs are subject to shipping charges and are the responsibility of the shipper.
Graphic Standards: Any reproduction of the Maui Jim logo, logotype, the words Maui Jim® or Maui Jim Sunglasses, or any Maui Jim trademark without the express written consent and authorization of Maui Jim is prohibited. This standard applies to any and all print and electronic media including but not limited to newspapers, catalogs, magazines, television, radio, and the World Wide Web.
Internet Policy: Maui Jim does not permit the selling of Maui Jim products on internet sites, such as eBay or any other website unless specifically authorized in advance by a written agreement. An account only has the authority to sell Maui Jim products in their brick and mortar store location. If an account is discovered to be selling on the Internet, that account will be terminated.
Warranty: Maui Jim sunglasses are warranted for two years against manufacturer’s defects. Maui Jim will replace or repair, at its option, any sunglass found to be defective. Damage caused from improper or unreasonable use, along with normal wear such as lens scratching and accidental breakage is not a manufacturer’s defect. Maui Jim lenses are not warranted against scratching.
Returns and Exchanges: Maui Jim sunglasses, in their original packaging and in condition suitable for resale, may be returned for merchandise credit or exchange. Damaged product will not be accepted for credit or exchange. All returns should be accompanied by the appropriate case, a copy of the original invoice, and an order indicating the styles to be sent in exchange for the returned sunglasses.
Repairs: Our repair department stands ready to service our accounts and the needs of their customers. Maui Jim offers special low-cost repairs and replacement parts. All charges will be applied directly to the account or the consumer, including shipping. We recommend that you or your customer call us on our toll-free number (888-628-4546) regarding any repair questions.
Fitting & Adjusting: If you need to adjust Maui Jim sunglasses for a better fit, as a general rule, please warm the nylon frame before bending or shaping it to fit.
Restricted Patent License and Anti-diversion Agreement ("License & Agreement"): Maui Jim sunglasses are protected by one or more U.S. patents owned by Maui Jim including U.S. Patent Nos. D481059, D481060, D483792, D488829, D489393, D508514, D539330, D539828, D539834, D540844, D540845, D542329, & D543230. When acquiring Maui Jim products, Recipient (including Dealer, Corporate Gift Account, Consignment Account, and any other recipient acquiring product from Maui Jim), is granted a non-exclusive license under Maui Jim Patents only to sell and offer for sale Maui Jim products at or above the MSRP directly to end-users, or to give Maui Jim products as a gift directly to end-users. No other right or license is granted or implied.
Recipient agrees (i) not to sell or otherwise transfer any Maui Jim products to any individual or entity that one might reasonably believe has the intention of reselling the products; (ii) not to advertise or solicit sales or sell Maui Jim products over electronic media such as the Internet, or through mail order (unless specifically agreed upon in writing); and (iii) to reimburse Maui Jim for its repurchase of Maui Jim products from any unauthorized entity or individual who received such products directly or indirectly from Recipient.
Recipient represents that it has the authority to execute a binding contract including this License & Agreement. By its execution of any agreement for the purchase and/or sale of Maui Jim products, Recipient acknowledges that it has read this General Policies form and agrees to all terms and conditions herein. Recipient further understands that any false or misleading information can result in its account being immediately and permanently discontinued, at any time, from doing business with Maui Jim, including revocation of the License and Agreement.
The interpretation and enforcement of the General Policies is governed by Illinois and applicable federal laws. All disputes arising out of or relating to the General Policies shall be litigated in Peoria County, Illinois.

Upon acceptance of this application and as a buyer in this
program, you the buyer agree that you will not sell Maui Jim
Sunglasses within your department or to any individual for
profit. You also agree to the Restricted Patent License and
Anti-diversion set forth in our . At no time
should Maui Jim Sunglasses be sold or diverted for resale
on the internet or through any other avenue.
A new sales agreement will need to be submitted with the
buyers every calendar year by submitting the Application
Form. After completing the Application Form and emailing
or faxing your ID, you will be sent two VIP cards to order your
sunglasses on www.mauijim.com. You cannot place an order
until you have received your cards. You are allowed two cards
per calendar year.
