This Privacy Policy (“Policy”) confirms your consent permitting us to process your data and sets out how Maui Jim Middle East Trading L.L.C (“Maui Jim” or “We,” or “Us”) uses and protects any information that you provide when you use this website (www.mauijim.com) and its mobile application (collectively the “Site”).
Maui Jim is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this Site, you can be assured that it will only be used in accordance with this Privacy Policy.
Maui Jim may change this Policy from time to time by updating this Policy. Please note that the Policy may be revised and reissued, prospectively by posting updated terms on this Site. Your continued use of the Site will be deemed as irrevocable acceptance of the Policy and any revisions. Information gathered by Maui Jim as a result of your use of the Site, is subject to this Policy. This Policy applies only to activities Maui Jim engages in on the Site and does not apply to Maui Jim's activities that are “offline” or unrelated to the Site.
Maui Jim collects certain anonymous data regarding the usage of the Site. By consenting to this Policy, you also agree that Maui Jim's exercise of the terms of this Policy as stated herein is not in violation of Articles 6 and 13 of the UAE Federal Decree-Law No. 34 of 2021 on Combatting Rumours and Cybercrimes (the “Cybercrimes Law”) or any other articles or laws. Kindly note that as per Article 6 of UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and its executive regulation (the “Data Protection Law”), you have the right to withdraw your consent at any time by emailing us at sales.ae@mauijim.com or calling us at +971 4 299 1207, provided that such withdrawal will not affect the legality and lawfulness of the processing of data made based on the consent given prior to the withdrawal.
2. USE AND DISCLOSURE OF INFORMATION
Except as otherwise stated below, we do not sell, trade or rent your personally identifiable information collected on the Site to others.
What do we do with the information we gather?
We maintain a special record for your personal data as required under Article 7(4) of the Data Protection Law. Further, we process your information and data for the purposes and cases noted under Article 4 of the Data Protection Law and to understand your needs and provide you with better service. By providing us with your personal information, you consent to us processing your personal information in one or more of the ways described in this Policy, including the following reasons or any similar reason:

Hotjar: Hotjar is a session recording and heat mapping service provided by Hotjar Ltd. Hotjar honors generic “Do Not Track” headers. Google Analytics: Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google utilizes the data collected to track and examine the use of websites and applications, to prepare reports on their activities, and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. All personal information that we obtain about you will be stored and retained in accordance with the Data Protection Law and this Policy.
Personal information submitted to or collected through our Site may be stored and/or processed in the United States of America, United Kingdom, Canada, Australia, European Union, or elsewhere provided that these countries have legislation on personal data protection therein or as the case may be according to Articles 22 and 23 of the Data Protection Law. By providing us with your information (including by using our Site), you consent to any such transfer of information outside of your country or region as long as it is in compliance with Articles 22 and 23 of the Data Protection Law.
3. PAYMENT INFORMATION
All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third-parties.
Please be assured of the caution we use regarding the personal information you provide during the checkout process. We have adopted security guidelines, rules, and technological measures to safeguard your personal information under our control from unapproved access, illegitimate usage and divulgence, and unapproved or incidental erasure or amendment.

Your credit card information submitted on the Site is stored and processed by a third-party which has contractually agree to comply with all rules, regulations, standards, or guidelines adopted or required by the credit card payment brands (including, without limitation, Visa, MasterCard, American Express, Discover, and JCB) and the UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services (the “Electronic Transactions Law”) relating to privacy, data security, and the safeguarding, disclosure, and handling of payment instrument information.
You consent to Maui Jim saving any documents or data related to any transactions you conduct in our Site as per Article 6 of the Electronic Transactions Law and those documents and data should be deemed as originals per Article 9 of the same law.
4. INFORMATION SHARING
We do not share personal information with companies, organizations, or individuals outside of Maui Jim and its affiliated companies (Maui Jim, Inc., Maui Jim Middle East FZE and other affiliated companies) except as stated above and as follows which you will be deemed to consent to once you agree to our Policy:
Consent: We will share personal information with companies, organizations or individuals outside Maui Jim when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information. Maui Jim may use non-personal “aggregated data” to enhance the operation of the Site, or analyze interest in the areas of the Site. Additionally, if you provide Maui Jim with content for publishing or feedback, we may publish your username or other identifying data.
Internal Use: Maui Jim shares information among affiliates and with third-party vendors, consultants, and other service providers who are working on Maui Jim's behalf and need access to your information to carry out work for Maui Jim as explained above.

Business Transitions: It is possible that as Maui Jim develops, there could be mergers, acquisitions, and asset sales or transfer that could result in a change in ownership or control of your personal information. If this were to happen, we would continue to ensure the confidentiality of your personal information and ensure that the proposed or consummated reorganizations in this case agree to the terms and obligations as stated herein in this Policy. You consent that your personally identifiable information may be provided to a third-party if Maui Jim files for bankruptcy.

Cookies are small bits of data cached in a user's browser. Maui Jim utilizes cookies to determine whether or not you have visited the home page in the past. However, no other user information is gathered.

We maintain procedural, technical, and physical safeguards for our online services to help protect against loss, misuse or unauthorized access, disclosure, alteration, or destruction of the personal information you provide via our online services. We also ask the processors, service providers and data protection officer1 that help us deliver our online services to do the same. Unfortunately, no transmission of data is guaranteed to be completely secure. It may be possible for third-parties not under our control to intercept or access transmissions or private communications unlawfully. Therefore, any transmission of personal information to Maui Jim is made at your own risk. It is important that you protect and maintain the security of any account you create and that you notify us immediately of any unauthorized use of any Maui Jim account. By accessing and using the Site, you accept that the level of security, at the time of logging in, is sufficient and the risk that any information you provide may be inadvertently disclosed to third-parties through an intrusion or violation of our security features. Maui Jim will have no liability whatsoever for any such disclosure. That being said, we adopted organizational policies in line with the Data Protection Law to handle any suspected data breach or infringement. Maui Jim will immediately upon becoming aware of any infringement or breach of your personal data notify you and the relevant government authority of such infringement or breach as required by Article 9 of the Data Protection Law and its executive regulation.
7. OTHER WEBSITES
Maui Jim is not responsible for the privacy policies of websites to which it links. If you provide any information to such third-parties, different rules regarding the collection and use of your personal information may apply. We strongly suggest you review such third-parties' privacy policies before providing any data to them. We are not responsible for the policies or practices of third-parties. Please be aware that our Site may contain links to other websites on the internet that are owned and operated by third-parties. The information practices of those websites linked to our Site are not covered by this Policy. These other websites may send their own cookies or clear GIFs to users, collect data or solicit personally identifiable information. We cannot control this collection of information. You should contact these third-parties directly if you have any questions about their use of the information that they collect.
8. MINORS
Maui Jim does not knowingly collect personal information from minors under the age of 21. Minors are not permitted to use the Site or its services, and Maui Jim requests that minors under the age of 21 not submit any personal information to the Site. Since information regarding minors under the age of 21 is not collected, Maui Jim does not knowingly distribute personal information regarding minors under the age of 21.

From time to time, we may revise this Policy to reflect industry initiatives, changes in the law or technology, or changes in our practices regarding information collection and use. 11. GOVERNING LAW AND DISPUTE RESOLUTION
This Policy is governed by the laws of the United Arab Emirates, including but not limited to, the Data Protection Law and its executive regulation, the Electronic Transactions Law, and the Cybercrimes Law.
Any dispute arising out of or in connection with this Policy shall be referred to a court of competent jurisdiction in Dubai.
